Terms of Service

1. Welcome

Thanks for using Sayfirst ("Sayfirst," "we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the Sayfirst mobile application and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

These Terms are between you and Csenge Forstner. Email us at support@sayfirst.ai for any question.

2. What Sayfirst is — and what it isn't

Sayfirst is an AI tool for understanding and responding to high-stakes personal communication. You bring a moment — something someone said, a message you're trying to answer, a dynamic you can't read — and the AI gives you back what's actually going on and what to do about it.

Sayfirst is NOT:

• Therapy or counseling
• Medical advice, diagnosis, or treatment
• A substitute for professional mental health care
• A crisis intervention service
• A medical device

If you are in crisis — including thoughts of suicide, self-harm, or harming others — please contact emergency services immediately:

• United States: 988 (Suicide & Crisis Lifeline) or text HOME to 741741 (Crisis Text Line)
• Outside the US: contact your local emergency line

You agree that you will not rely on the Service as a substitute for professional medical or mental-health care.

3. Who can use Sayfirst

You must be at least 13 years old to use Sayfirst. We confirm this at onboarding. If you are under 13, you may not use the Service. If we discover that someone under 13 has registered, we will delete that account.

If you are between 13 and 18, you affirm that a parent or guardian is aware of your use of the Service.

By using Sayfirst, you represent that you have the legal capacity to enter into these Terms.

4. Your account

Sayfirst works anonymously by default — a unique anonymous identifier is generated on your device and used to associate your activity across launches, with no name, email, or phone number required.

You may optionally create an account with an email address and password so you can sign in on another device or recover access. You're responsible for keeping your password secure and for activity under your account.

If you use Sayfirst anonymously and your device is lost, sold, or accessed by someone else, your Sayfirst data may be visible to them, and we have no way to recover or transfer an anonymous account if your device is lost.

5. AI-generated content

The guidance, reads, drafts, and other interpretive responses you receive from Sayfirst are generated by AI. You should know:

• AI output may contain errors, omissions, or claims that aren't accurate. Don't rely on AI output as factual or as professional advice.
• AI output is not consistent. The same input may produce different outputs over time as the underlying model is updated.
• You're responsible for evaluating whether the AI's response matches your situation before acting on it.
• The AI is not a person. It does not have feelings, memory of you across separate sessions outside what we explicitly persist as your Self Model, or independent judgment.

We are responsible for how we deploy the AI in this Service. Specific information about our AI provider is in the Privacy Policy.

6. Acceptable use

You agree NOT to use Sayfirst:

• For any unlawful purpose
• To attempt to extract, copy, or republish AI outputs as if they were authored by a person
• To reverse-engineer, decompile, or attempt to extract source code or AI model weights from the Service
• To send automated traffic, scrape, or otherwise abuse the Service
• To upload content that infringes anyone else's rights (including intellectual property, privacy, or publicity rights)
• In a way that could harm minors
• To attempt to circumvent the safety features (crisis detection, age gate, content guards)

If you use Sayfirst in violation of these Terms, we may suspend or terminate your access without notice.

7. Your content

You retain all rights to anything you write into Sayfirst ("Your Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

• Process Your Content through the AI to generate responses for you
• Store Your Content on our backend for the purpose of providing the Service
• Derive a private model of your patterns to make future responses specific to you (your Self Model)

This license is limited to operating the Service. We do not use Your Content to train AI models, sell to third parties, or for advertising. The Privacy Policy describes data handling in detail.

You can export or delete Your Content at any time from Profile → Download my data and Profile → Delete all my data. Deletion removes all your data from our systems within 30 days.

8. Subscriptions and payment

The Service is currently free. If we introduce paid features in the future, we'll update these Terms with subscription terms before any charge.

9. Intellectual property

Sayfirst, including the app code, design, brand, copy, prompts, and AI orchestration logic, is owned by Csenge Forstner and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for your own personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service.

The third-party software and services we use are owned by their respective owners and used under their respective licenses. Specific providers are listed in the Privacy Policy.

10. Privacy

Your use of Sayfirst is also governed by our Privacy Policy. It describes what data we collect, how we use it, who we share it with, and your rights.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT THE AI'S OUTPUT WILL BE ACCURATE, USEFUL, OR APPROPRIATE FOR YOUR SITUATION; OR THAT THE SERVICE IS SUITABLE FOR ANY PARTICULAR USE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CSENGE FORSTNER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE; ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (CURRENTLY ZERO, AS THE SERVICE IS FREE), OR (B) ONE HUNDRED US DOLLARS.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Csenge Forstner from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) your misuse of the Service.

14. Termination

You may stop using Sayfirst at any time. If you want to remove your data, use Profile → Delete all my data.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you've violated these Terms or for any other reason at our discretion.

Sections 5, 7, 9, 11, 12, 13, 14, 15, and 17 survive termination.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms in the app or at sayfirst.ai/terms and update the "Effective date" at the top. Your continued use of the Service after the effective date of the updated Terms means you accept the changes. If you don't agree, please stop using the Service and delete your account.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.

Any dispute arising out of or related to these Terms or the Service will be resolved in the state and federal courts located in California. You and we both consent to the personal jurisdiction of those courts.

If you are a consumer in a jurisdiction with mandatory consumer-protection rules (such as the EU or UK), nothing in these Terms limits the protections you have under your local law.

17. Miscellaneous

• Entire agreement: These Terms (and the Privacy Policy referenced in section 10) are the entire agreement between you and Csenge Forstner about the Service.
• No waiver: Our failure to enforce any provision of these Terms is not a waiver of that provision.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the rest of these Terms remain in effect.
• No assignment: You may not assign or transfer your rights under these Terms. We may assign these Terms to an affiliate or successor.
